Terms of Service

These terms of service ("Terms") govern your use of the Breakout app and related services (the "Service") provided by Breakout Sports AB ("Breakout", "we", "us"), company registration number 559585-5445, with its registered office in Borås, Sweden. Please read these Terms carefully before using the Service. By creating an account or using the Service, you accept these Terms. These Terms should be read together with our privacy policy; information about cookies is available at breakoutsports.se/cookies and a simplified explanation for readers under 18 at breakoutsports.se/integritet-ung. The Terms are available in Swedish and English — in the event of any discrepancy, the Swedish version prevails. Functional links to both these Terms and our privacy policy are available within the app and adjacent to the subscription purchase screen.

§1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our privacy policy. These Terms constitute a binding agreement between you and Breakout.

  • If you do not agree to these Terms, you must not create an account or use the Service.
  • Certain users (trainers, scouts, and clubs) must expressly accept these Terms as part of the verification process before they are granted full access.
  • You must accept these Terms before you can upload or publish content within the Service.

We maintain a zero-tolerance policy toward objectionable content and abusive behavior. By using the Service, you undertake to comply with the rules set out in the section on prohibited use.

§2. About the Service

Breakout is a talent and scouting platform for sports that connects players with scouts, trainers, and clubs. The Service is provided as a mobile app and associated web services.

  • Players build profiles and upload performance videos and a profile picture.
  • Scouts, trainers, and clubs can search for and discover players, follow profiles, compare and rate players, and organize tryouts and training events.
  • The Service includes social features such as a video feed, likes, comments, event chat, challenges with video submissions and leaderboards, following, as well as XP, achievements, and awards.
  • Some features are free, while others (premium features) require a paid subscription tied to your role.

We may develop, change, or remove features of the Service at any time. The Service is provided "as is" and does not constitute an employment or agency agreement, and Breakout does not guarantee that contacts made through the platform will lead to selection, a contract, or any other outcome.

§3. Account, Eligibility, and Age

To use the Service, you must register an account in one of the roles of player, scout, trainer, parent, or club. You are responsible for the activity on your account.

  • You must be at least 13 years old to create a player account. We do not allow accounts for people under 13 – registration is blocked if the date of birth provided shows the person is under 13, and if we discover such an account afterwards it is deleted.
  • If you are between 13 and 17 years old, the Service must be used with a legal guardian’s knowledge and consent. Your age is self-declared and is not separately verified. Player accounts for minors (13–17) are set to private by default the first time a date of birth is provided, and visibility to scouts and trainers is off by default.
  • A parent or legal guardian can link a guardian account to a player’s profile and thereby temporarily freeze the account, request its deletion (with a 30-day grace period), and approve or decline tryout applications for players under 15.
  • You must provide accurate and complete information and keep your details up to date.
  • You are responsible for keeping your login credentials confidential and secure and for all activity that takes place through your account.
  • You must notify us immediately if you suspect unauthorized access to your account.

Your date of birth is provided by you at registration and is not separately verified. Once a date of birth has been entered, you cannot change it yourself; any change must be requested and approved by us.

§4. Profile, Visibility, and Privacy Settings

Your settings govern who sees your profile and your videos. For adult players the profile is public by default; you can set the account to private in settings at any time. For players aged 13–17, a private account is the default.

  • With a private account, your videos are shown only to followers you have approved. Videos from private accounts do not appear in the public feeds (Latest and Popular) for anyone but your approved followers.
  • Visibility to scouts and trainers is governed by separate settings. When they are off, verified scouts and trainers cannot find you in search or suggestions, and they cannot view your private account. A scout or trainer who already follows you can, however, still see you.
  • Trainers and verified scouts can rate players who allow it. You can switch off future ratings in settings; ratings already given can be hidden from your profile but remain in the system. Ratings are visible to you and to trainers and scouts – never to other players.
  • Users who have provided a gender can enable the gender-matched feed. The setting is off by default and the filtering is bidirectional in the Latest tab. Scouts and trainers always see all players.
  • If a verified scout, trainer, or club visits your profile, you can see who it was if you have an active subscription. Other players never see who visited your profile.
  • You can share a link to a video outside the app. Share links do not work for videos from private accounts or from users under 18, and a shared link stops working if the video is removed.

§5. Verification and Organizations’ Data Responsibility

Users in the trainer, scout, or club roles must be verified before they are granted full access to the Service. Verification is carried out manually by us.

  • You upload a document (e.g. a UEFA certificate, FIFA license, club ID, employment certificate, or organizational certificate) that substantiates your role. Documents are stored privately and handled with time-limited access.
  • You certify that the documents and information you upload are genuine, accurate, and pertain to you or the organization you represent. Providing misleading information or claiming to represent an organization without authorization is prohibited.
  • Until your verification has been approved, you cannot use the Service in full. The review is carried out manually and may take up to 48 hours.

When you, as a verified trainer, scout, or club, process players’ personal data for your own purposes – your own notes, watchlists, ratings, rosters, events, and squad selections – you or your organization are the controller for that processing, and Breakout processes the data on your behalf as a processor. As a verified user you therefore undertake to:

  • Use the platform’s data and search features solely for legitimate scouting, recruitment, and team-administration purposes, in accordance with the GDPR.
  • Not share player data, search results, or player lists with unauthorized third parties, and not contact players or their families outside the Service’s contact features unless the player initiated the contact.
  • Inform people whose data you enter into the Service yourself – for example the names of team members who do not hold an account – that the data has been recorded.
  • Notify us immediately if your organization loses its authorization or changes its line of business.

Full processor terms (a data processing agreement) are provided on request via dataskydd@breakoutsports.se. We may refuse, revoke, or re-review a verification if we have reason to believe that the information provided is inaccurate or misleading, and misuse of player data results in immediate suspension.

§6. Your Content and License

You retain ownership of the content you upload, such as videos, photos, comments, messages, and ratings. By uploading content, you grant us certain rights to provide the Service. Videos are selected from the device’s photo library – there is no recording feature in the app, and the app does not request camera or microphone access.

  • You grant Breakout a non-exclusive, royalty-free, worldwide license to store, display, distribute, and make your content available within the Service for the purpose of operating and improving it.
  • This license applies for as long as your content remains in the Service. When you delete content or your account, the license ends, subject to a reasonable period for removal and backups and to content that other users have lawfully saved.
  • We use your content in our own marketing only if you have expressly approved it in advance. For players under 18, the guardian’s approval is always obtained. You can withdraw an approval at any time, but material already published externally cannot always be retracted.
  • You warrant that you own or have the necessary rights to the content you upload and that the content does not infringe any third-party rights (e.g. copyright, trademark, or personal rights).
  • You are solely responsible for your content and for obtaining the necessary consents from individuals who appear in it. If minors appear in a video, a guardian’s approval is required.

If you believe that content within the Service infringes your intellectual property rights, you can report this to info@breakoutsports.se and we will investigate and remove any content that proves to be infringing. See also breakoutsports.se/upphovsratt.

§7. Challenges and Prizes

We regularly organize time-limited challenges that players can enter by uploading video submissions. Challenges are created and administered solely by us.

  • Participation is voluntary and requires a public account – submissions are publicly visible for the duration of the challenge. A minor with a private account therefore cannot upload a challenge entry without first making the account public.
  • Scoring is either automatic (based on likes, comments, and views) or manual by our team. Each challenge has a leaderboard visible to all users.
  • Any prizes, selection criteria, and special rules are always stated with the specific challenge. Prizes cannot be exchanged for cash unless otherwise stated, and for cash prizes the recipient is responsible for any tax.
  • We reserve the right to disqualify participants who have manipulated their results and to change, cancel, or withdraw a challenge or a prize for reasons beyond our control.

§8. Prohibited Use

You undertake to use the Service responsibly and in accordance with the law. The following is not permitted:

  • Uploading or sharing illegal, offensive, sexually explicit, hateful, violent, discriminatory, or misleading content.
  • Harassing, threatening, bullying, abusing, or exploiting other users, particularly minors.
  • Impersonating someone else or providing false information about yourself, your role, or your authorization.
  • Infringing the intellectual property rights or privacy of others.
  • Using automated tools (e.g. scraping) to collect data, or attempting to circumvent security or moderation measures.
  • Using the Service for unauthorized commercial purposes, spam, or fraud.

Violating these rules may result in the removal of content as well as the suspension or termination of your account. Sexual content involving minors and contact attempts for improper purposes (grooming) are always reported to the police.

§9. Content Moderation, Reporting, and Blocking

We maintain a zero-tolerance policy toward objectionable and inappropriate content and behavior. Content within the Service may be reviewed and moderated both automatically and manually.

  • Profile pictures and videos are reviewed automatically to detect explicit content, and content that breaches the rules may be blocked or rejected. Flagged content is reviewed by a human, and you can request reassessment of a rejected submission.
  • You can report other users, videos, and comments directly in the app.
  • You can block other users in the app. When you block a user, mutual follows and any pending follow requests are removed, and you can manage blocked users in the app.
  • We review incoming reports and may remove content, hide content, issue warnings, suspend, or terminate accounts. Content from a user reported by several distinct users may be temporarily hidden from the feeds pending review.

We undertake to act on reports of objectionable content without undue delay, normally within 24 hours, by removing the content in question and/or suspending the user who breached the rules. For copyright complaints and questions about content or reports, you can contact us at info@breakoutsports.se. Moderation is carried out in accordance with these Terms and with Apple’s and Google’s rules on user-generated content.

§10. Subscriptions and Payments

Certain premium features require a paid subscription tied to your role (e.g. Player Premium, Pro for scouts and trainers, Parent Premium, and Club Premium). Subscriptions are purchased and managed through the Apple App Store or Google Play. Subscriptions are offered with a recurring billing period, for example monthly or yearly. The exact subscription length (the length of the billing period) and the price of the subscription you choose are clearly shown in the app and on the purchase screen before you complete the purchase.

  • The subscription runs for the chosen billing period (for example one month or one year) and renews automatically for a further period of the same length at the same price until you cancel it. The specific period and price are shown at the time of purchase. Your store account is charged within 24 hours before the start of each new period.
  • To avoid renewal, you must cancel the subscription at least 24 hours before the end of the current period.
  • You manage and cancel your subscription in the settings of your App Store account (iOS) or Google Play account (Android). Deleting the app does not cancel the subscription, and we cannot ourselves cancel a subscription that is charged through the stores.
  • Prices, the chosen billing period, and the subscription length are shown in the app and at the time of purchase in your currency and including applicable VAT.
  • Payments are handled by Apple and Google. Your card details are handled entirely by Apple and Google and are never stored by Breakout.
  • A club subscription may, where applicable, also grant premium access to the club’s active trainers.
  • Functional links to these Terms and to our privacy policy are available within the app and are shown adjacent to the subscription purchase screen.

Refunds for purchases made through the App Store or Google Play are handled in accordance with Apple’s and Google’s respective rules and must be requested from the relevant store. Any free trial period, its length and terms, are governed by the stores’ offers and shown at the time of purchase; if no trial is shown, none is offered.

§11. Right of Withdrawal

As a consumer within the EU, you generally have a 14-day right of withdrawal under distance-selling law when purchasing digital content and digital services at a distance. The withdrawal period runs for 14 days from the day on which the contract was concluded.

  • To exercise your right of withdrawal, you must, before the withdrawal period expires, send us a clear and unambiguous statement of your decision to withdraw from the contract. You can do this by contacting us at info@breakoutsports.se, for example using the following wording: 'I hereby give notice that I withdraw from my contract for the following service: [subscription], ordered on [date]. Name: [your name]. Order/account reference: [email linked to the account]. Date: [date].' You may also use the model withdrawal form provided by your national consumer authority. It is sufficient that you send your notice before the withdrawal period has expired.
  • For digital content and digital services, the right of withdrawal is lost once delivery has begun, provided that you have expressly consented to delivery beginning during the withdrawal period and acknowledged that you thereby lose your right of withdrawal. When a subscription is activated, we obtain your express consent and your acknowledgement that the right of withdrawal is lost at the time of purchase, and you receive confirmation of that consent on a durable medium (for example by email or the purchase receipt from the store).
  • If you have not given such express consent, or if delivery has not yet begun, you may exercise your right of withdrawal within 14 days as described above and obtain a refund.
  • For purchases made through the App Store or Google Play, requests for refunds are handled in accordance with Apple’s and Google’s respective rules and are made through the relevant store.

Nothing in this section limits the mandatory consumer rights you have under the law of your home country.

§12. Intellectual Property

Breakout, our logo, and all material and software included in the Service (with the exception of users’ own content) belong to Breakout or our licensors and are protected by intellectual property law.

  • You may use the Service for personal, non-commercial use in accordance with these Terms.
  • You may not copy, modify, distribute, sell, rent, or create derivative works of the Service or its content without our written permission.
  • Trademarks, logos, and brand identifiers may not be used without our permission.

§13. Limitation of Liability

The Service is provided "as is" and as available. We strive to provide a secure and functional service but cannot guarantee that it will always be error-free, secure, or uninterrupted.

  • We are not responsible for content published by other users or for contacts, agreements, or outcomes between users.
  • To the extent permitted by law, we are not liable for indirect damages, loss of profit, or loss of data.
  • We are not responsible for interruptions or errors caused by third-party services, internet connectivity, or your device.

Nothing in these Terms limits or excludes our liability to the extent such liability cannot be limited under mandatory law, and these Terms do not restrict your mandatory consumer rights.

§14. Indemnification

You undertake to hold Breakout harmless against claims, damages, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your submission of prohibited content, or your infringement of third-party rights.

This undertaking does not apply to the extent the claim is caused by Breakout’s own conduct, and it does not restrict your mandatory consumer rights.

§15. Termination and Suspension

You may terminate your account at any time, and we may suspend or terminate accounts in the event of a breach of these Terms.

  • You can delete your account directly in the app (Settings → Security → Delete Account) or at breakoutsports.se/delete-account. Upon deletion, your personal data is permanently erased within 30 days.
  • If you delete your account yourself in the app, a 30-day grace period applies during which you can reactivate the account by logging in again, after which the deletion is carried out.
  • We may suspend or terminate your account with or without prior notice if you breach these Terms, if content must be removed under the moderation section, or if required by law.
  • If your account is terminated, your right to use the Service ceases. You must cancel any active subscription charged through the App Store or Google Play yourself in the relevant store; any refund is handled in accordance with the stores’ rules.

Certain data may be retained after termination where required by law or to prevent abuse, in accordance with our privacy policy.

§16. App Stores (Apple and Google)

When you download and use the app through the Apple App Store or Google Play, the following terms also apply in relation to those stores. In the event of a conflict, this section takes precedence on matters relating to Apple, in all cases subject to your mandatory consumer rights, which this section never restricts or overrides.

  • These Terms are entered into solely between you and Breakout, not with Apple. Apple is not a party to the agreement.
  • You are granted a non-transferable license to use the app on Apple-branded products that you own or control, in accordance with the usage rules set out in the Apple Media Services Terms and Conditions.
  • Breakout is solely responsible for the maintenance and support of the app. Apple has no obligation whatsoever to provide any maintenance or support for the app.
  • Breakout is solely responsible for any warranties. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price; otherwise, Apple has no warranty obligations and all other warranty claims are handled by Breakout.
  • Breakout, and not Apple, is responsible for addressing any claims from you or a third party relating to the app, including product liability, failure to comply with legal or regulatory requirements, and consumer protection claims.
  • In the event of a third-party claim that the app infringes intellectual property rights, Breakout, and not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim.
  • You represent that you are not located in a country that is subject to a U.S. trade embargo or that has been designated by the U.S. as a terrorism-supporting country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
  • You must comply with applicable third-party terms when using the app (e.g. your mobile carrier’s terms).
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, have the right to enforce them against you.
  • Purchases through Google Play are subject to Google Play’s terms and refund policies. Google is not responsible for the Service or its support.

Breakout’s name and contact details for complaints and claims are set out in the contact section below. This section does not limit any rights you have under mandatory consumer protection law.

§17. Changes to These Terms

We may update these Terms, for example as the Service develops or when legal requirements change. We always indicate the date of the most recent update.

  • In the event of material changes, we will notify you in good time by email or in the app before the changes take effect.
  • If you do not accept material changes, you may terminate your account before they take effect.
  • Continued use of the Service after the changes have taken effect constitutes your acceptance of the updated Terms.

§18. Disputes and Governing Law

These Terms are governed by Swedish law. However, if you are a consumer, this may not deprive you of the protection afforded by the mandatory rules of the country in which you are resident.

  • We aim, first and foremost, to resolve any disputes amicably. Please therefore contact us at info@breakoutsports.se and we will try to find a solution.
  • If you are a consumer, you may refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, www.arn.se, for free-of-charge resolution of the dispute. We participate in ARN’s proceedings.
  • If the dispute cannot be resolved by other means, it may be heard by a general court in Sweden, subject to a consumer’s right to bring proceedings before a competent court under mandatory law.
